Vendor Registration Agreement
This Vendor Registration Agreement (“Agreement”) governs the relationship between KabadiwalaOnline.in (the “Platform”) and any scrap vendor, kabadi shop, recycler, or independent pickup handler (“Vendor”). By registering as a Vendor, you agree to the following binding terms.
KabadiwalaOnline.in is legally classified as:
- A digital intermediary under IT Act 2000, Sec. 2 & Sec. 79
- An online service aggregator under Intermediary Guidelines 2021
- A non-scrap-dealer entity (no buying, selling, storing, transporting of scrap)
- A lead/referral provider only
The Platform DOES NOT:
- Buy scrap
- Sell scrap
- Set scrap prices
- Employ field staff
- Provide transport, weighing tools, or scrap containers
All field operations are performed solely by independent vendors.
To register, Vendor must:
- Be 18+ years old
- Possess valid ID (Aadhaar/PAN)
- Use accurate name, address, phone number
- Have the right to operate scrap-related activity as per local laws
- Follow Indian scrap, e-waste, SWM & GST guidelines
Providing false documents may result in immediate termination.
This Agreement does NOT create:
- Employment relationship
- Partnership or joint venture
- Franchise or agency
Vendor operates INDEPENDENTLY and bears full personal responsibility for:
- Rates
- Weighing
- Conduct
- Transport
- Payments
- Complaints
- On-ground activities
KabadiwalaOnline.in’s role ends at providing customer leads.
- Platform may share leads based on availability & location.
- Lead quantity is NOT guaranteed.
- Vendor may voluntarily pay a “Service Token Fee” after successful pickup.
- GST applies only if Platform revenue crosses ₹20,00,000/year.
This is NOT commission on scrap value.
VENDOR AGREES TO:
- Use fair, calibrated digital weighing machines.
- Offer clear & honest communication with customers.
- Behave respectfully and professionally.
- Maintain safety & hygiene at customer premises.
- Avoid overcharging, fraud, or misleading claims.
- Carry valid ID during visits.
- Follow all Indian recycling & waste disposal rules.
VENDOR MUST NOT:
- Use abusive language
- Force a sale
- Manipulate weights
- Misquote prices
- Threaten customers
- Sell or buy stolen items
- Engage in illegal scrap activities
Violation may result in blacklisting and legal complaint.
Vendor must:
- Confirm price BEFORE pickup
- Use transparent weighing IN FRONT OF THE CUSTOMER
- Provide correct payment immediately after final weighing
- Not demand unnecessary charges
- Not force the customer to sell after negotiation
Customer complaints may lead to immediate suspension.
Vendor must honor confirmed pickups.
If vendor cancels without reason:
- Vendor may be suspended
- Lead access may be restricted
- Repeated cancellations lead to permanent removal
If customer cancels after confirmation:
- Customer may be charged ₹300+
- Vendor must inform the platform to avoid dispute
The Platform is NOT responsible for:
- Vendor behavior or misconduct
- Wrong weighing
- Damage to property
- Delay, no-show, or cancellation
- Payment disputes
- Theft, fraud, or cheating by vendor
- Disagreement in quality or quantity
- Any physical injury or loss during pickup
Vendor ACCEPTS FULL LEGAL RESPONSIBILITY for all on-ground actions.
KabadiwalaOnline.in has full “Safe Harbour Protection” under IT Act Sec. 79.
Vendor must comply with:
- Indian Penal Code (IPC)
- IT Act 2000 & Intermediary Rules 2021
- Consumer Protection Act 2019
- GST Act (if applicable)
- E-Waste Management Rules 2022
- Solid Waste Management Rules 2016
- Local scrap/shop/transport rules
Vendor is solely responsible for obtaining any required local permissions.
Vendor may NOT deal in:
- Stolen items
- Illegal goods
- Hazardous materials without license
- Government property
- Confidential corporate documents
- Weapons & restricted metals
Vendor must inform authorities if suspicious material is found.
- Vendor pays customer directly—Platform has NO involvement.
- Payment method may be:
- UPI
- Cash
- Bank Transfer
- Platform does NOT guarantee or verify payment.
- Vendor receives ONLY relevant customer details.
- Vendor must NOT sell, share, or misuse customer data.
- Any data misuse results in permanent ban + legal action.
- Disputes are between Vendor & Customer only.
- Platform does NOT mediate financial disputes.
- Platform may provide conversation history for clarity.
- Legal jurisdiction: NCR, India.
Vendor may be suspended for:
- Fraud
- Weight manipulation
- Misbehavior
- Threatening customers
- Illegal scrap dealings
- Misuse of customer data
- Repeated cancellations
- Criminal activity
Suspension may be permanent without notice.
Vendor agrees to indemnify and hold KabadiwalaOnline.in harmless for any:
- Customer complaint
- Theft allegations
- Fraud cases
- Damage claims
- Non-payment disputes
- Legal notices
- Police complaints
- Court cases
- Regulatory penalties
Vendor bears complete and exclusive liability.
Terms may be updated at any time. Continued vendor activity means acceptance.
