KabadiwalaOnline.in is a digital intermediary under:

• Information Technology Act, 2000 (Section 2 & Section 79)
• Intermediary Guidelines 2021
• GST Circular 11/11/2017-GST

The platform ONLY connects customers with independent scrap vendors, buyers, recyclers, and pickup handlers.

All transactions occur directly between the customer and third-party vendor.

By accessing this platform, you confirm:

• You are at least 18 years old.
• You are using accurate details.
• You are legally capable of entering into a contract (Indian Contract Act, 1872).

Vendors must:

• Submit valid ID (Aadhaar/PAN)
• Provide accurate business details
• Follow fair weighing practices
• Maintain respectful behavior
• Comply with local scrap and recycling laws

KabadiwalaOnline.in may remove any vendor without notice for:

• Fraud
• Misconduct
• Unfair weighing
• Customer harassment
• Fake identity or documents

• All bookings are passed to verified independent vendors.
• The platform does NOT guarantee pickup time, rate, or vendor availability.
• Customers must verify vendor ID physically at the time of pickup.

• Scrap rate is decided ONLY between customer & vendor.
• KabadiwalaOnline.in does NOT fix or influence prices.
• Payment is given directly to the customer by the vendor.
• Platform is NOT responsible for non-payment or delayed payment.

• Once a pickup is confirmed, vendor time & travel is reserved.
• If customer cancels after confirmation:
  • A cancellation charge of ₹300+ is applicable.
  • Non-payment may result in blocking from future services.
• If vendor cancels without valid reason:
  • Vendor may be blacklisted or suspended permanently.

• Customers are NOT charged any scrap fee.
• Platform may charge vendors:
  • Service Token Fee
  • Digital Access Fee
• GST is applicable ONLY if platform revenue crosses ₹20,00,000 annually.

All physical interactions happen solely between customer and vendor. Under IT Act Section 79, the platform has full “Safe Harbour Protection” as a digital intermediary.

Customers must:

• Verify vendor ID
• Check weighing scale
• Stay present during weighing
• Avoid handing scrap without confirmation
• Ensure safe environment during pickup

Vendors must:

• Carry valid ID
• Use fair and transparent weighing
• Behave respectfully
• Ensure no fraud or misrepresentation
• Follow recycling laws for e-waste & scrap

Any misconduct leads to immediate blacklisting.

Users may NOT:

• Upload fake information
• Pretend to be someone else
• Use bots or spam tools
• Harass vendors or customers
• Misuse service or waste vendor time
• Attempt illegal scrap activities
• Sell stolen or prohibited items

Such actions may result in:

• Account termination
• Legal action
• Report to authorities (IPC 415, 420, 379, 503, etc.)

All content (text, design, logo, graphics) belongs to KabadiwalaOnline.in.

Unauthorized copying, duplication, or misuse is prohibited.

• We collect minimal personal data for pickup & verification.
• Data is shared ONLY with matched vendors.
• We NEVER sell or trade customer data.
• You can request deletion at any time.

KabadiwalaOnline.in is NOT responsible for:

• Links to external websites
• Third-party tools
• Vendor-owned weighing machines
• Vendor communication style
• Vendor mistakes or errors

We comply with:

• IT Act 2000 & Rules 2021
• Consumer Protection Act 2019
• E-Waste Management Rules 2022
• Solid Waste Management Rules 2016
• GST Law (Service Intermediary Classification)

We are NOT a scrap dealer and do NOT require scrap licenses.

By using this platform, you agree to indemnify and hold KabadiwalaOnline.in harmless from any claim, loss, damage, dispute, or legal action arising from:

• Vendor actions
• Customer actions
• Weight disputes
• Price disputes
• Physical injury or property damage
• Payment delays
• Fraud or misbehavior by third parties

• All disputes MUST be resolved between customer and vendor.
• Platform does NOT mediate financial or physical disputes.
• For legal purposes, jurisdiction is NCR, India.

KabadiwalaOnline.in may update T&C anytime without prior notice. Continued use means acceptance of new terms.
